Investor protection — SEBI, AMFI grievance redressal
Multiple layers of protection. Most issues resolve at AMC level; SEBI SCORES platform for unresolved complaints.
Indian mutual fund investors benefit from a multi-layered protection framework. SEBI regulates the industry; AMFI provides industry-wide grievance mechanisms; individual AMCs operate customer service. When something goes wrong, the right escalation path resolves most issues. Knowing where to take a complaint matters as much as having the right to complain.
The three-layer structure
Layer 1: AMC customer service
Most issues resolve here:
- Operational queries.
- Transaction issues.
- KYC updates.
- Statement requests.
- Nominee updates.
AMC customer service is reached through:
- AMC website contact forms.
- Toll-free phone numbers.
- Email support.
- Branch visits (for major AMCs).
Layer 2: AMFI
For unresolved or industry-wide issues:
- AMFI customer service forum.
- Investor education resources.
- Distributor-related complaints.
Layer 3: SEBI SCORES
SEBI's Complaints Redress System (SCORES) is the final escalation:
- Web-based complaint registration.
- Mandatory AMC response within 30 days.
- Tracking of resolution status.
- Escalation to higher SEBI authorities if not resolved.
Common complaint categories
Transaction issues
SIPs not executing, redemption not credited, switches not processed. Almost always resolve at AMC level.
Capital gains statement errors
Incorrect cost basis, missing transactions, wrong tax categorisation. Resolve at AMC level usually.
Transmission delays
Slow processing of nominee transmission after a holder's death. AMC escalation usually accelerates.
Mis-selling complaints
Distributor recommended unsuitable products. Layer 2 (AMFI) or Layer 3 (SEBI) typically.
Fraud or unauthorized transactions
Critical to escalate immediately:
- AMC customer service to freeze the folio.
- SEBI SCORES for formal complaint.
- Police report if criminal.
How to file a SCORES complaint
- Visit scores.sebi.gov.in.
- Create an account or login.
- Select "File a complaint".
- Choose the entity being complained against.
- Provide details, supporting documents.
- Submit; receive complaint number.
Required documents
- Folio number.
- Transaction details.
- Email correspondence with the entity.
- Identity proof.
- Specific issue details.
Timeline expectations
- AMC response: typically 7-15 days for routine queries.
- Formal escalation to SEBI: AMC has 30 days to respond.
- Total resolution: typically 1-3 months for SCORES complaints.
Mis-selling protection
Mis-selling means a distributor recommended unsuitable products through:
- Misrepresentation of risks.
- Hidden charges.
- Inappropriate risk-return mismatches.
- Pressure tactics.
Mis-selling protection requires:
- Documentation of the recommendation.
- Evidence of unsuitable advice.
- Causal link between advice and loss.
Fraud protection
For investor fraud (unauthorized transactions, identity theft):
- Immediate AMC notification.
- Police report.
- SEBI SCORES complaint.
- Bank notification (if cash flow affected).
Investor Education and Protection Fund
SEBI maintains an Investor Education and Protection Fund (IEPF) financed by:
- Unclaimed dividends.
- Unclaimed mutual fund proceeds.
- SEBI's reserve.
The IEPF supports investor education and can be accessed by claimants for unclaimed amounts.
Unclaimed amounts and recovery
Unclaimed amounts in mutual funds (older than 3-7 years depending on type) get transferred to AMFI's "Unclaimed Investor Database". Investors or their heirs can:
- Search the database with PAN.
- File claims with supporting documents.
- Receive unclaimed amounts.
Distributor regulation
Distributors (MFDs) are regulated by AMFI:
- Code of conduct.
- Continuing education requirements.
- Complaint mechanism through AMFI.
SEBI's role in protection
SEBI provides:
- Regulatory oversight of AMCs.
- Operating rules and disclosures.
- Penalty for violations.
- Investor education through SEBI Investor Education Programme.
What SEBI cannot do
- Compensate for investment losses (markets carry inherent risk).
- Reverse legitimate market decisions.
- Intervene in advisory recommendations that turned out poorly.
Pre-complaint hygiene
Before filing a complaint:
- Document the issue clearly.
- Try AMC customer service first.
- Keep all email correspondence.
- Note transaction reference numbers.
- Get specific advice in writing where possible.
Statute of limitations
For most issues, prompt action is needed:
- Mis-selling complaints: typically within 1-2 years.
- Transaction errors: prompt complaint matters.
- Fraud: as soon as discovered.
Don't delay; older claims are harder to investigate and resolve.
Investor education resources
- SEBI Investor Education Programme.
- AMFI Investor Awareness initiative.
- AMC investor education resources.
- SEBI's Investor Education and Protection Fund-funded programs.
The protection ecosystem
The Indian mutual fund protection framework is among the most developed in emerging markets. Most investors will never need to escalate beyond AMC customer service. But knowing the escalation path exists provides confidence and ensures resolution paths are available when needed.
The investor's responsibility
Protection works best when investors:
- Understand what they're investing in.
- Read SIDs and key disclosures.
- Document transactions and advice.
- Escalate issues promptly.
- Use SCORES when AMC-level resolution fails.
The framework provides paths; the investor must use them when needed.
